A good piece from an expert witness on the Society for Computers and Law website addressing the potential pitfalls for those both wanting digital transformation and those offering the service.

There’s a good anecdote about a senior manager who “had insisted on a highly specific fixed-price contract for an ill-defined approach to changing operations.” He got what he paid for, as the saying goes. And was unhappy with the outcome.

There’s always more than an element of risk for both parties in any digital transformation project. William Hooper‘s suggestion that “an honest contract would state in the recitals that this is an experiment” is spot on.

Plenty to reflect on, particularly in relation to what an expert witness will look for when things go wrong.
