New Data Sharing Code of Practice

A new Data Sharing Code of Practice came into force on 5 October 2021. Put together by the Information Commissioner’s Office to replace a 2011 code, it aims to provide clear guidance and practical tools to businesses and organisations on how to share data lawfully, while protecting people’s personal information.

The Code includes advice on transparency, on the lawful bases for using personal data and the requirement to record processing activities.

Annex A of the Code is a useful data sharing checklist and there are some helpful case studies at Annex C.

It’s a statutory code made under section 121 of the Data Protection Act 2018 which means the ICO must take the Code into account when considering whether organisations have complied with their data protection obligations when sharing data.
